Forfeiture - 2000 - Estates Gazette Case Summaries [2000] EGCS 24(1) .

"Mount Cook Land Ltd v Hartley and others" ChD 11 February 2000. Landlord seeking to forfeit a valuable lease on a commercial premises. Tenants subletting in breach of covenant to sublessees of good financial standing. Claimant brought proceedings claiming forfeiture on the grounds that sublettings had been in breach of covenant. Defendants counterclaimed for relief and asked for retrospective consent to the sublettings. "Held" defendants were entitled to relief.
