R v Durham CC - 2000 - New Property Cases [2000] 24 NPC 1-4(4) .

CA 8 March 2000. The Court holds that not withstanding the deeming provisions of the 2nd Schedule to the Planning and Compensation Act 1991an individual can compel an applicant for the registration of an "old" mining planning permission to submit an environmental planning assessment when seeking registration and that the deeming provisions as to the grant of a consent after three months have no effect.
