Negligent valuation - 2000 - Estates Gazette Case Summaries [2000] EGCS 36 (1) .

ChD 7 March 2000. "Ball v Banner and others; Neill Clerk (a firm) v Healey & Baker (a firm)". NC sponsored an investment scheme. The investors brought a negligence claim against NC alleging some misrepresentations in the prospectus. The claimant firm NC, sought Part 20 contributions from the defendant valuer HB on the basis that statements attributable to HB in the prospectus were misleading to investors. The main issues were whether HB owed a duty of care to investors, and whether it was in breach of duty. Held, HB was liable for 25% of the damages.
