CA 1 March 2000. "R v Braintree DC, ex p Halls". H and his father were tenants of a house in Essex. Council conveyed property was subject to covenant as a single private dwelling. Years later, H wante d to sell part of the land as a building plot. Council agreed but wanted payment from profits. Whether council's decision was lawful under the Housing Act 1985. Application for review of council's decision dismissed. Held, appeal allowed.
