ChD 30 March 2000. "Cottingham and another v Attey Bower and Jones". Issue revolved around liability and measure of damages. In 1993 the claimants bought an old house renovated by vendors without obtaining building regulation approval. It was assumed by the claimants that such approval had been obtained. Argued whether defendant liable for cost of remedying all defects. Held, claimants had established liability, but could only recover £8,203, rather than the original claim of £40,279.
