Chelsea Yacht & Boat Co Ltd v Pope - 2000 - Estates Gazette [2000] 22 EG 139-143(5) .

CA 6 April 2000. C held an annual licence from the Port of London Authority, authorising it to grant mooring licences and charge fees for mooring on the Thames, Battersea. C was also the owner of a houseboat moored alongside other boats for which they provided services. The previous owner of the houseboat had let it to the respondent tenant, P, at an annual rent payable monthly. At first C extended the agreement but then sought possession for failure to pay rent. It was held in the court below that the letting was an assured tenancy within Housing Act 1988 Part 1. C appealed contending the houseboat was a chattel. Appeal allowed.
