"Jolley v Carmel Ltd" ChD 7 June 2000. Claimant seller purported that defendant buyer had rescinded his contract to purchase a former convalescent home on the grounds that he was in breach of an implied obligation to make reasonable efforts to obtain the granting of planning permission. Held that the contact was still on foot at date of claim.
