LT 14 January 2000. Compulsory purchase of grassland grassland with hardstanding and a 210 sq ft shed. In November 1991, possession was taken of 0.13ha of the smallholding in requirement of a road scheme. To be decided whether the correct basis of compensation was under the Land Compensation Act 1961 S5 r(5) for the cost of reinstatement for the sum of £10,125, The defendant argued that the correct calculation was the market value under the Land Compensation Act 1961 S5 r(2). Rules were simplified under the Lands Tribunal Rules 1996 r28. 'Decision' compensation was determined for £3,500 in accordance with the Land Compensation Act 1961 S5 r(2).
