CA 24 January 2000. The appellant landlord S owned 3 acres of land near Gatwick Airport let to the respondent tenant. The tenant G occupied the site as a car park. S opposed the application for a new tenancy under the Landlord and Tenant Act 1954 s30(1) on the grounds that he intended to occupy for the same purpose of business. Planning permission for the car-parking use of the property was conditional on the use being carried out in the name of the tenant company. The landlord appealed against the County Court decision. 'Held' appeal allowed.
