ChD 18 May 1995. Purchaser Safehaven (X) entered into contract with vendor Springbok (Y) to purchase lease subject to two conditions which must be satisfied within two months. The contract was never completed. Alleged misrepresentation of over-status of sub-tenant. S purported to repudiate the contract. Y did not accept and continued to request information from X to complete agreement. Y agreed to repudiate the contract. Held, Y was not required to repay the deposit in accordance with the Law of Property Act 1925 s49(2).
