Considers the decision in "Cruden Construction Ltd v Commission for the New Towns" (1994) relating to the validity of two notices of arbitration served by the Commission, as a result of which the RIBA president appointed an arbitrator. At issue was whether there was an existing dispute between the parties when the notices were served.
