Caradon DC v Paton and another

Caradon DC v Paton and another - 2000 - Estates Gazette [2000] 35 EG 132-136(5) .

CA 10 May 2000. C were owners of two houses previously occupied by tenants. The houses were sold to the tenants under the right to buy provisions of the Housing Act 1980. C brought proceedings against the present owners of the houses, claiming that their use of the properties was against a restrictive covenant - in that they were using them for holiday purposes only and not living in them. Court held that the properties were being used as private dwelling houses. C appealed. Appeal allowed.
