QBD 20 June 2000. SoS gave an undertaking that an area of land, forming part of the Winchester bypass, would be retained as chalk grassland. The land was owned by the Highways Agency. Hampshire CC wanted to develop the land and obtained planning permission.. They then sought to obtain the land from the Agency. A local conservation group then pointed out that if the land was no longer required by the Highways Agency, the Crichel Down Rules applied to its disposal. Highways Agency agreed sale of land to council. Minister accepted sale could proceed as an exception to the Crichel Down Rules. Applicant sought judicial review of that decision. "Held" application was dismissed.
