"R v Restormel BC ex p Parkyn and another". CBD 13 September 2000. Land and Property Ltd was the owner of Victoria Business Park. The park had three outline planning permissions, respectively for 1993,1994 and 1997 that allowed further areas to be given to non-food retail use. Various bodies were concerned that implementation of the permissions would cause financial damage to shopping centres nearby. In 1999 a local public inquiry was held. The conclusion being that the three permissions had strayed from relevant policies. In 2000 the SoS removed non-food retail use from the 1997 permission. Council applied to have their own decisions quashed, and application made by individual councillors. Applicants sought to uphold legality of permissions. "Held" application dismissed on the alternative ground.
