"Next Generation Clubs Ltd and another v SOS Environment and another" CA 9 October 2000. The appellents applied for planning permission to develop Helen Road Sports Ground in Romford, Essex which had minimum usage. The application proposed improvements to indoor and outdoor sporting facilities, and a unilateral planning obligation was proffered at the planning inquiry. The inspector rejected the application for the development on the grounds that it would result in the loss of open space, additional vehicular traffic, an impingement on nearby residential dwellings and would fail to meet the recreational needs of the community. The applicants appealed under Town and Country Planning Act 1990 S288. The judge dismissed the application. The applicants appealed, contending the inspector had provided inadequate reasoning for his decision. "Held", appeal allowed.
