A closer look at Mannai

Lovitt

A closer look at Mannai - 2000 - Estates Gazette (0042) 21 October 2000, 170-171(2) .

The findings in the case of "Mannai" represented a turning point in judicial attitudes to erroneous notices. Since the decision it has become clear that the Mannai principle has a wider application than was first thought. It may apply to statutory as well as contractual notices. However, discusses several decisions subsequent to "Mannai", which have established limitations on the principle. For instance, "Mannai" will only assist the server of a notice if there is an obvious error on the face of the notice, and a reasonable recipient would not have been misled by it. Concludes that there can be no substitute for clear and concise drafting.
