CA 6 April 2000. A houseboat, moored to a pontoon and to the bank and bed of a river in which it took to the ground at half tide, was let to B by an agreement very similar to that for the letting of a dwelling house. Water, electricity and other services were provided to the houseboat. A sold the houseboat to C. Shortly afterwards C sought possession from B for failure to pay rent. The judge held that the agreement was a tenancy under which a dwelling-house is let within Housing Act 1988 s1(1). C appealed. Held, appeal allowed. Since the Housing Act 1988 only applied to the letting of land, the agreement under which B occupied the houseboat was not a tenancy of a dwelling house for the purposes of s1 of the Act.
