Looks at the Contracts (Rights of Third Parties) Act 1999 in the context of property transactions. To date, the Act has had a limited effect on property transactions, and practitioners have excluded the application of the Act from their documentation. Suggests this has been a hasty approach, and examines four key areas where the Act could have a positive impact for practitioners and their clients: freehold covenants; leases and subleases; collateral warranties; section 106 agreements.
