"Markfield Investments Ltd v Evans" CA 9 November 2000. A occupied a dwelling-house and land in Cornwall, and claimed continuous and exclusive occupation of the land since the summer of 1977. In August 1990, the then owner of the property brought an action against A for possession. This was finally dismissed in January 1999 for want of prosecution. In July 1999 the appellant (B) succeeded to the title of the land and brought an action for possession. Hearing considered whether the first action stopped time running in favour of B. The judge held that adverse possession was not interrupted. Appeal dismissed.
