Discusses "R v Director-General of Fair Trading ex p Benhams Ltd", one of the few cases which has tested the Estate Agents Act 1979. his involved a firm of estate agents which sought to force a reluctant director-general of fair trading to exercise his statutory powers. The case highlighted two key points: taking a bribe from a purchaser does not put an agent in breach of the 1979 Act; lying to a client may amount to an "undesirable practice" under the Act.
