LCA/171/1997, 29 March 2003. Examined whether a landlord (W) should be paid compensation for the loss of income while prevented from letting the property by a closing order served by Bournemouth BC (B) in order to carry out substantial repair work to make the property fit for human habitation. W claimed he was entitled to compensation equal to the difference between the amounts which the property would have been expected to realise if sold in the open market immediately before and after the making of the closing order. It was held that no compensation was payable to W under the Housing Act 1985 s584, for the making of the closing order as there had been no diminution in the compulsory purchase value of the owner's interest in the property as a result of the making of the closing order.
