Looks at retrospective effects of contracts and the implication for the Construction Act referring to the decision in "Atlas Ceiling & Partition Company Ltd v Crowngate Estates (Cheltenham) Ltd". A contract may be made on the date when outstanding matters of agreement between the parties are resolved and have retrospective effect: this gives rise to a situation where disputes which arise prior to 1 May 1998 are nevertheless brought within the ambit of the Act.
