Reports on the situation in Germany where public procurement decisions are routinely challenged for breaching EU rules on how contracts should be awarded. At present such challenges in the UK are rare but, with EC concern about the procurement procedures used in PFI/PPP projects, they may occur more often. In order to combat this, UK public authorities may have to review their methods or risk a challenge.
