In pursuit of justice in the construction industry: reflections on arbitration and adjudication

Colledge, B.

In pursuit of justice in the construction industry: reflections on arbitration and adjudication - 2000 - Arbitration 66(4) November 2000, 252-257(6) .

Examines the impact on arbitration and adjudication of the European Convention on Human Rights Article 6, which outlines the rights to a fair and public hearing for the determination of civil rights and justice, detailing possible conflicts between the Human Rights Act 1998 and the Arbitration Act 1996 and Housing Grants, Construction and Regeneration Act 1996. Concludes that it is not clear that the Human Rights Act will affect current practice, but that the general principles of the European Convention have been met. Recent case law is also considered.
