CA 21 December 2001. Looks at the issue of whether landlord (W) owed a duty of care in preventing nuisance caused by a tenant. Another tenant had complained to W of nuisance created by neighbour. W applied for claim to be struck out. Court considered whether W liable for nuisance or owed duty of care and whether it was appropriate to strike out claim. CC had struck out claim. Appeal dismissed.
