Notes that the Housing Grants, Construction and Regeneration Act 1996 s104(2) defines a construction contract as any agreement to do architectural design or surveying work or even to give advice on building, engineering, interior or exterior decoration in relation to construction and that consequently clients can bring adjudication proceedings against the design team. Concludes that forms of appointment and conditions of engagement should allow for adjudication and that members of the design team should ensure that they have adequate professional indemnity insurance cover.
