When does a partnership exist? - 2001 - Solicitors' Journal 145(2) 19 January 2001, 45(1) .

Examines "Khan v Miah" and the implications for partnerships and all other collaborative commercial ventures. Although the partnership, for which there was no formal agreement, had failed before the restaurant had been opened the HL ruled that many commercial activities involving expenditure had taken place and that the parties had clearly been working together in a common enterprise and that K was entitled to a settlement. Concludes that a partnership exists where there is an intention to make a profit rather than once that profit has been realised.
