"London Baggage Co v Railtrack plc (No 2)" ChD 19 December 2000. In October 1994 A signed a tenancy agreement which excluded statutory compensation from landlord (B) where the period of business occupation was less than five years. In February 1998 B served a notice stating that the unit was required for redevelopment. The protected tenancy terminated on 29 September 1998, but A remained in occupation as a tenant at will, and finally quit the premises in May 2000. A claimed compensation on the grounds that the relevant period was five years and seven months, when it had physically quit the premises. The judge ruled for B.
