Advises that the extent of the impact of any covenants or rights that exist, or are likely to come into existence, must be examined carefully and that important terms must be clearly defined in writing. Notes that there is a need for solicitors to be proactive and actively monitor the process if they are to avoid charges of negligence on the grounds of inadequate supervision.
