QBD 24 January 2001. St James Homes (S) applied for planning permission but the site was actually found to be within the green belt after S appealed against the council's non-determination of application. SOS dismissed the appeal and refused planning permission. S held that the SOS had failed to consider relevant policies in the development plan. Claim allowed.
