CA 30 January 2001. The landlord (H) applied for a determination of fair rent within 2 years of a previous rent registration after carrying out repairs under a repair notice. The West Sussex Rent Officer refused H's application on the grounds that the repairs did not constitute a change in the condition of the property and an application for a judicial review was also turned down. Appeal allowed.
