CA 19 January 2001. The tenants (P) of a building with flying box balconies, felt that the landlord (PP)had breached the repairing covenant by not keeping the roof terraces repaired. PP held that P had agreed in the leases to repair and maintain the flat, walls and ceilings including where the balconies were part of these. The judge held that the obligations of both parties overlapped in the terms of the lease; the landlord appealed. Appeal allowed
