Reviews the High Court decision "R v SoS Environment ex parte Holding & Barnes plc" that certain aspects of the Secretary of State's powers are not compatible with human rights legislation. The court found that the Secretary of State is not an independent and impartial tribunal and this was not remedied by the existence of a limited right of appeal to the High Court.
