Warns that designers, authorities and contractors need to be aware when designing and constructing buildings to give sufficient consideration to how they might be affected by other developments later. Failure to consider the impact of building near rivers may make planning authorities liable for flood damage caused downstream. Looks at the case of "Bybrook Barn Centre Ltd v Kent CC" (2001), the main concern was the flooding of a culvert under a highway being inadequate to cope with increased water flow caused by significant developments built upstream.
