Describes the case of "Weldon Plant Ltd v The Commission for New Towns [2000]", the findings of the arbitrator, and the differing view of the Technology and Construction Court, regarding a disagreement over payment for additional work carried out by a contractor. The arbitrator found that the bill rates could not be applied, and that a fair rate should be used. The Technology and Construction Court disagreed with the arbitrator. It held that where the contract calls for work to be valued according to fair rates and prices, these should include: an allowance of profit; a contribution towards the business's fixed costs and overheads. Contends that this case, along with "Henry Boot v Alstom" , reveal the courts' preference for holding parties to the agreement they have made by using bill rates to calculate the pricing of varied or additional work.
