Compares expert determination and arbitration, and presents reasons why each is used. Includes a useful summary of procedural/substantive differences. Concludes that it is impossible to find a practical reason for choosing expert determination over arbitration. Despite its illusory advantages of speed, reduced cost and informal procedure, warns that in choosing expert determination parties are forsaking an internationally enforceable award, and an established system of domestic and international laws.
