The judicial review of the IR35 tax rules has ended, with Mr Justice Burton indicating that they are unlikely to be overturned. Further remarks by the Judge, that it seemed illogical to tax consultants as employees if they were not also to be entitled to employee benefits, could also cost employers £2bn. Although the comment falls outside the remit of the judicial review it may be sufficient to establish consultants' right to employee benefits.
