In Shulem B Association Ltd's Appeal - 2001 - Estates Gazette [2001] 11 EG 175-180(6) .

LT 21 December 2000. Landlord (A) owned the freehold of a detached block of four flats. Each was held on a 99 year lease granted in 1961. Three of the four tenants exercised their right to acquire the freehold, and a purchase price of £14,000 was set by the Leasehold VT for the collective enfranchisement of the freehold. A appealed on a number of grounds, which included: the value of the existing lease in the "no 1993 Act world"; the effect of the absence of a mutual enforceability clause; whether the price should include the hope value of the flat owned by the tenant who was not participating in the process. Appeal allowed. A new purchase price of £29,816 was determined.
