"Esso Petroleum Co Ltd v Fumegrange Ltd and others" CA 5 July 1994. Proceedings for possession of a petrol-filling station under RSC Ord 113 was valid as there was no lease. The agreement, which included E`s substantial rights and powers over the premises, for example the right to make alterations to the premises, did not create a tenancy but a licence.
