CA 21 December 2001. The parties attempted to settle a boundary dispute before the trial. The defendant D made an offer to settle the dispute under CPR Pt 36 by letter on 9 March 2000 but withdrew the offer by letter dated 13 March. The offer was expressed to be open for 21 days. The CC held that D was not entitled to withdraw the Part 36 offer unillaterally . CC ruling overturned. CA held that D was entiled to withdraw. Appeal allowed.
