Discusses the situations of a compulsory purchase order being placed on a property and a fire destroying a property after contracts are exchanged (concluded in Scotland), and highlights that in England the buyer is more likely to bear the risk than in Scotland. Also looks at the issues of penalty for late completion and paying deposits for each country. Concludes that cross-border commercial differences can be tackled by using agents and lawyers who have experience of deals in England and Scotland.
