"McDonald's Property Co Ltd v HSBC Bank plc", ChD 25 April 2001. A occupied a building for a 21-year term that commenced in June 1991. The rent was subject to an upwards-only review every 7 years. Landlord (B) was entitled to initiate the review, and in August 1999 served a notice proposing an annual rent for the 7-year period commencing 1998. A contended that the notice was too late. B claimed that the court was bound by the rule affirmed by HL - that time was not of the essence in rent review clauses. "Held": judgment was given for B.
