Discusses the scope and implications of the recent consultation paper, "Electronic Conveyancing, a draft order under section 8 of the Electronic Communications Act 2000", in the context of conducting the whole conveyancing process electronically. Outlines the key elements of the draft regulations which will allow the use of electronic contracts and signatures, and summaries the current law regarding the form of contracts and conveyances. Considers the impact of the Homes Bill and sellers information packs and questions whether a role for lawyers will still exist in the future. Concludes that the draft regulations only cover a small part of the conveyancing process, and introducing electronic contracts and signatures alone will not greatly increase speed.
