Possession regained
- 2001
- Estates Gazette (0121) 26 May 2001, 163(1) .
Discusses the consequences of the HL ruling in "Cadogan Estates Ltd v McMahon". At issue was whether a landlord was entitled to regain possession under Rent Act 1977 Case 1 from a tenant who was bankrupt. It concluded that a proviso for re-entry can, for the purposes of the Rent Act, be regarded as creating an obligation and therefore a tenant who is made bankrupt is susceptible to a possession order.
