Discusses the definition of concurrent delays given by the courts in "Henry Boot Construction (UK) v Malmaison Hotel (Manchester)" and "Royal Brompton Hospital NHS Trust v FA Hammond and others" arguing that it was not clear in the latter ruling whether only delays that occur at exactly the same time are concurrent, what happens when two critical delays overlap but do not meet this definition, and how the court would distinguish between critical and a non-critical delay.
