Suggests that the Human Rights Act 1998 will have a greater impact on property law than generally anticipated, considering the ruling in "Aston Cantlow and Wilmcote with Billesley PCC v Wallbank" (WB3721-08) that chancel repairing liabilities contravened the Act, that the PCC was a public authority and thereby obliged to comply with the European Convention on Human Rights, and that this tax was implemented arbitrarily and out of proportion to its purpose bringing it into conflict with Article 1 as well as Article 14 of the Convention.
