"Spath Holme Ltd v Chairman of the North Western Rent Assessment Committee and another", QBD 12 July 2001, examined the fundamental purpose of registration, which was to fix a rent for the premises so that any tenant was protected from paying excessive sums. The Landlord (S), ignoring the above issue, appealed against the committee's (N) determination of a fair rent. However the committee had erred in law by assuming an absence of voids and letting costs in the hypothetical market of regulated tenancies. The appeal was allowed.
