L G Caltex Gas v China National Petroleum - 2001 - Building Law Reports [2001] BLR 235-252(18) .

QBD 19 January 2001. Involved a dispute over two alleged contracts arising from negotiations for importing and marketing liquid petroleum gas in southern China. An arbitrator was appointed but his jurisdiction was challenged. The issues examined by case was whether an 'ad hoc' submission had been agreed and whether any challenges to the arbitrator were barred. It was decided that the parties had agreed to an 'ad hoc' submission and that the arbitrator therefore had jurisdiction but that any successful challenges to the arbitration awards could only be made under the Arbitration Act 1996 s68 or s69.
