Should an arbitrator or adjudicator act as a mediator in the same dispute? - 2001 - Arbitration 67(3) August 2001, 221-229(9) .

Examines the role of a mediator in a dispute where he is also appointed to act as adjudicator or arbitrator. Argues that in such a case the adjudicator or arbitrator's decision or award could be challenged on the grounds of lack of impartiality or concerns about natural justice. Considers that an arbitrator or adjudicator can act as a mediator in same dispute as long as all parties are aware of the implications and take appropriate steps to ensure there is no confusion as to the appropriateness of the approach in question.
