Submerged lands are public lands lying below tidal waters in the continental United States.The public lands are held in fee simple estate until an ecumbrance is created through a lease or other vehicle. The bundle of rights is allocated to the lessor (public domain) and the lessee (private use), which establishes a leased fee estate when a usage fee (lease amount) is created for tidal lands.
